H3 trainee visa is the license granted to the non immigrant foreigners who come to US with the motive of getting trained by an employer. This visa is a temporary one which permits you to get trained in any field other than graduate education or training. The H3 trainee visa can be availed through the petition form I-129. This petition must be filed by the employer showcasing the following: A description about the training plan, schedule, faculty, number of classroom hours, role of the trainee in the agenda, the previous experience, qualifications, experience of the trainee, etc. The H3 trainee visa petition must also hold the reason why the trainee chose US and the program, whether he is not able to get the same in his home land, what are his key benefits, what are the benefits to the employer, the cost effectiveness of the program, etc. H3 trainee visa is also given for people who train special children with physical, mental or emotional disabilities. The same procedure has to be followed for them too including the detailed report about their completion of degree in special education, experience details, etc. The petition form I-129, petition for non immigrant worker consists of the basic petition format and other vital statistics related to various categories of workers. Along with the main petition, supportive documents must also be filed with the USCIS (United States Citizenship and Immigration Services). On approval of your petition, you will receive a notice of approval, form I-797. Then you have to apply for the visa with your country’s consulate where approval notice is sent. In case you have an exemption from visa, then the same would be sent to POE or Port of Entry. If you are already in the US and changing from one non immigrant status to another, then you do not need the visa. The H3 trainee visa petitions should be filed with in 6 months to 45 days of commencement of the employment and not before or after that specified time period. You have to be aware that granting a visa does not permit you to enter the US, the CBP or Customs and Border Protection has got the power of denial of your entry. The CBP authorities will issue form I-94 which species your arrival and departure called the Record of Arrival-Departure.
