US Immigration

United States Immigration is a dream to many across the globe. The reasons being technological advancement, economic growth, world class education, job opportunities that U.S offers unbiased to the inhabitants of the world.

Prior to the September 11 attacks, United States Immigration was relatively an easy process. The process has become quite lengthy and stringent to offer a balance between the nation’s security aimed towards healthy migration.

The U.S. Immigration is broadly classified into:

unlimited immigrants(no numerical limit)

limited immigrants(subject to annual numerical limit)

Unlimited immigrants are immediate relatives or returning residents. Immediate relatives can be spouse, unmarried minor children, widow(er) of a U.S citizen.

People who were previously the lawful permanent resident of U.S and returning back to the country after staying abroad for not less than a year fall into the returning residents category. However people who have filed special permissions to stay for long are also considered.

The limited immigrants are broadly classified as family based, employment based and diversity immigrant visa lottery benefactors.

There are four levels of preferences for family based United States Immigration according to which a visa can be issued. The first preference goes to unmarried sons and daughters of U.S citizens. Spouses, children and unmarried sons and daughters of LPR aliens fall at the second level. While married sons and daughters of U.S. citizens with their spouses and children occupy the third preference level, the fourth one is meant for the brothers and sisters of the U.S citizens with their spouses and children of the U.S citizen. Age limitations apply as amended by the Embassy.

Employment based United States immigration visas are prioritized as follows:

* Priority workers,

* Members of the professions,

* Professional, skilled and unskilled workers

* Special immigrants

* Investors

The first three levels have an annual percentage limit of 28.6% while the last two have a limit of 7.1%. The diversity immigrant visa lottery is meant for the inhabitants of those nations which show low rates of U.S. Immigration.

With the intention of preventing illegal migration to the United States, a multi year plan named the SBI (Secure Border Initiative) was put forth by DHS (Department of Homeland Security) in the last quarter of 2005. This program is effectively enforced by the U.S. Immigration and Customs Enforcement. Consult an authorized counselor to decide on the right immigrant visa for you.
